La UE y el patrimonio cultural: retos pendientes en relación con el patrimonio cultural subacuático

Abstract

The material cultural heritage, and within it, the underwater cultural heritage, are today facing serious threats not only from illicit activities, such as the plundering or illegal trafficking of goods, but also from perfectly legal activities such as urban planning. These threats require a response not only from the States, but also reach those International Organizations with competences in culture, mainly UNESCO and the Council of Europe. In this paper we intend to give a general vision on the protection of cultural heritage within these Organizations. We will also focus on the action of the European Union in terms of culture, focusing on the underwater cultural heritage. As the action of the European Union can be quite limited with regard to the protection of the underwater cultural heritage, we will also look at other policies or areas of action of the European Union which, even if they do not have as their ultimate goal the protection of cultural heritage, can indirectly contribute to this end, by protecting other interests such as the environment, marine biological resources or tourism among others.

El patrimonio cultural material, y dentro de éste, el patrimonio cultural subacuático, se encuentran hoy en día enfrentados a graves amenazas provenientes no sólo de actividades ilícitas, tales como el expolio o el tráfico ilegal de bienes, sino también de actividades perfectamente legales como la planificación urbanística. Estas amenazas requieren una respuesta no solo por parte de los Estados, sino que alcanza también a aquellas Organizaciones internacionales con competencias en materia de cultura, principalmente la UNESCO y el Consejo de Europa. En este trabajo pretendemos dar una visión general sobre la protección del patrimonio cultural en el seno de dichas Organizaciones. Nos detendremos también en la acción de la Unión Europea en materia de cultura, centrándonos en el patrimonio cultural subacuático. En la medida en que la acción de la Unión Europea puede resultar bastante limitada por lo que a la protección del patrimonio cultural subacuático se refiere, nos fijaremos también en otras políticas o ámbitos de actuación de la Unión Europea que, aunque no tengan como fin último la protección del patrimonio cultural, sí pueden contribuir indirectamente a dicho fin, al proteger otros intereses tales como el medio ambiente, los recursos biológicos marinos o el turismo entre otros.
